Lindemans Privacy Policy and Cookie Statement 

 

1. General 

This Privacy Policy and Cookie Statement (hereinafter referred to as the ‘Policy’) informs you about the way in which your personal data is collected and processed via the www.lindemans.be website (hereinafter referred to as the ‘Website’), and about the use of cookies on the Website. The specific way we deal with your data however depends also on the relationship that we have with you.

BROUWERIJ LINDEMANS NV, having its registered offices at Lenniksebaan 1479, 1602 Sint-Pieters-Leeuw, Belgium and registered with the Crossroads Bank for Enterprises under number 0433.144.689 (hereinafter referred to as ‘Lindemans’, ‘we’, ‘our’ or ‘us’), is the data controller with respect to the processing of the personal data we collect and receive from you via the Website. 

We operate in compliance with the EU Regulation of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as any applicable national implementing or additional legislation (hereinafter referred to as the ‘GDPR’).

For the purposes of this Policy, ‘personal data’ means any personal data as defined under the GDPR, i.e. any information relating to an identified or identifiable individual. 

This Policy was last updated on 12 December 2025 and may be amended from time to time, based among other things on new regulations or directives, or new practices and insights. We therefore recommend that you consult this Policy on a regular basis, so that you are kept informed of the latest state of affairs.


2. Purposes and legal grounds of the processing 

2.1. General 
We collect and process your personal data solely for the purposes specified in this Policy. More specifically, Lindemans processes your personal data for the following purposes: the provision of the Website and related services; brewery booking for visits or for private events; managing the contractual relationship between you and Lindemans, including your participation in certain contests or promotional activities; managing customer and prosect databases; verifying that your use of the Website complies with our terms of use and applicable law; responding to your requests, questions, and/or complaints.

In addition, Lindemans may process your personal data in order to monitor the use of the Website and related services, your visits to them, analyze user habits, develop add-ons or new features to improve the Website and conduct market research. When the purposes of such processing can be achieved in this manner and to the extent possible, Lindemans will give priority to the processing of aggregated data (i.e., data that cannot identify you or be linked to you, such as statistical data), pseudonymized or anonymized data, over the processing of personal data.

2.2. Direct marketing

If you consent to the use of your personal data for commercial and advertising communications (direct marketing), we will process your personal data for the purposes to which you have consented until such consent is revoked, if applicable. With your express consent when you provide your email address, we may send you, by email or personalized displays on certain social networks where you have an account, commercial and advertising communications concerning our products/services. If you wish Lindemans to stop processing your personal data for commercial and advertising communications, you have the right to withdraw your consent in this regard at any time, free of charge and without having to provide any justification. To exercise this right, simply follow the procedure described in Section 6 of this Policy.

2.3. Legal grounds  

Under the GDPR, the processing activities described in this Section 2 are based on the following legal grounds: (i) your consent; (ii) the necessity for the performance of the contractual relationship between you and Lindemans (as well as for the performance of pre-contractual measures taken at your request); and/or the legitimate interest of Lindemans, without prejudice to your rights and freedoms that would take precedence. This concerns in particular the security of the services provided by Lindemans, including the security of Lindemans’ infrastructure and systems and the prevention of fraud in general.

We reserve the right, pursuant to a legal authorization/obligation or on the basis of your consent, to use your personal data for new purposes that are not yet provided for in this Policy. It is understood that prior to using your personal data for other purposes, we will inform you of any changes to this Policy. In the case of activities based on consent, you will also have the option of not accepting these changes.

The Website uses cookies that we use to improve your browsing experience, among other things. More information on the use of cookies can be found below under Section 10. 

3. Data that we process
Every time you visit the Website, we first ask you to confirm whether you have reached the minimum age for alcohol consumption. For more information, we refer to Section 9 below. We will also ask you to indicate your language and country preference each time.

The following categories of personal data are collected and processed on the Website: 

  • ‘browsing data’ i.e. personal data relating to your general use of the Website and related services: identifier of the device you use to access the Website (MAC address), IP address, selected language, data relating to when you use the Website and for how long, information relating to your operating system and device type, search criteria (e.g., product type), pages visited; 

  • ‘newsletter date’ i.e. personal data relating to your subscription to our newsletters: email address, first and last name, log of acceptance of legal documents; 

  • ‘contact data’ i.e. personal data that you provide when completing our online contact form: your first and last name, email address, subject and content of the message, log of acceptance of legal documents and, facultatively, your company name, address and mobile number;  

  • ‘booking data’ i.e. personal data that you provide when completing our online form for booking brewery visits: your first and last name, email address, mobile phone number, language choice for the visit, date and time of the visit, number of attendees, log of acceptance of legal documents and, facultatively, your company name and address; 

  • ‘complaint data’ i.e. personal data that you provide when completing our online complaint form: your first and last name, postal email address, report date, complaint details, supporting documents and, facultatively, your phone number.

In connection with your use of the Website and related services, Lindemans does not collect or process any special categories of personal data about you, unless you voluntarily provide such data, for example when filling in our online contact form. Special categories of personal data are commonly referred to as ‘sensitive’ personal data and refer to information relating to racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, or genetic data or data concerning health or your sexual orientation.  


4. With whom we may share your data 
We never sell your information to third parties for commercial or other purposes. The basic premise is that your data will only be used within Lindemans. Certain personal data will, however, be shared with third-party service providers who will process it, such as our promotional and marketing agencies and our IT, accountancy, auditing and legal service providers and insurers. The data may also be shared with: 

  • third parties for the purposes for which you have given specific permission; and 

  • third parties who provide services to you on our instructions (like subcontractors who assist us in our service provision to you, third parties who provide printing services and/or for the printing of personalized publicity, gift vouchers or other correspondence, postal and courier services for the delivery of the prizes won, the gift vouchers and, if applicable, other goods purchased), insofar as they have confirmed to us that they comply with the GDPR; and 

  • third parties whereby this sharing is imposed on us by law or other regulations, pursuant to a lawsuit or by a government/administration or pursuant to a judicial or arbitration award. 


Finally, we are entitled to disclose to the competent authorities, strictly in compliance with applicable law, data related you that we believe is necessary to prevent physical damage or financial loss or in connection with an investigation into alleged or actual fraud or illegal activities.


In any instance, the transfer will be limited to what is necessary to achieve the relevant purpose. In general, Lindemans will not transfer your personal data to third parties, except for transfers authorized by applicable law, or mentioned in this Section 4 or elsewhere in this Policy.

You also consent to the transfer of your personal data in the event of a sale or transfer by Lindemans to a third party of all or part of its business or assets.

In the event that your personal data is transferred to countries outside the European Economic Area that are considered by the European Commission to not provide an adequate level of protection for personal data, for the purposes specified in this Policy, we will ensure that measures are put in place in accordance with the GDPR, where applicable, by signing the standard contractual clauses adopted and made available by the European Commission. 


5. Retention periods
In principle, all personal data are only retained for as long as necessary for the intended purposes specified in Section 2. We will retain your personal data for a longer period only if Lindemans has a specific legitimate interest in retaining your personal data in this way (for example, (i) if it is necessary to defend Lindemans’ interests in court, insofar as the data would be required to clarify an alleged violation of third party rights, or (ii) to comply with a legal obligation or other regulations, pursuant to a lawsuit or government request or pursuant to a judicial or arbitration award).  

More specifically, and without prejudice to the generality of the foregoing, 

  • we retain your browsing data for as long as you do not delete them, or in any case, for a maximum period of 12 months from your last activity; 

  • your newsletter data is retained for as long as you do not object to its processing by Lindemans (see the procedure to follow in Section 10);  

  • your contact data, booking data and complaint data are retained for a maximum period of 12 months from the completion of the processing of your request.  

Lindemans will regularly check which personal data is no longer useful for the purposes specified above, in order to delete it or make it anonymous.

6. Your rights 

You have the right to access, rectify or change your personal data at any time. We would like to draw your attention to the fact that you are the only one who is responsible for the accuracy of the data you provide to Lindemans.

You can also ask us to limit the use of your data if the legal requirements are met. In that case, we will continue to store your data, but we will restrict the use of it.

You also have the right to be forgotten. We will delete the personal data without undue delay in the cases stipulated in the GDPR.

You also have the right to object to the processing of your data if you believe that there are serious and justified reasons for this. You are not entitled to object if this processing is necessary for the fulfilment of contractual obligations. As far as processing for direct marketing purposes is concerned, you can object at any time without justifying your decision.

You can obtain or have transferred the personal data that you gave us.

In general, you also have the right to withdraw your consent at any time for any processing based on that consent (where applicable). This withdrawal does not affect the lawfulness of processing based on consent prior to withdrawal.

If you believe that the processing of your personal data constitutes a violation of the GDPR, you have the right to lodge a complaint with a supervisory authority, in particular in the EU Member State of your habitual residence, your place of work, or the place where the violation occurred. The supervisory authority for Belgium is the Data Protection Authority (https://www.dataprotectionauthority.be/). 

You can exercise your rights free of charge by sending a written and signed request to the e-mail address info@lindemans.be or to the postal address Lenniksebaan 1479, 1602 Sint-Pieters-Leeuw (Belgium), together with a copy of the front of your ID card or other identification document, as well as any document proving that you are the person concerned by the personal data.

You are entirely free to share or not to share your personal data with Lindemans. However, please be aware that it will be impossible to provide certain services or respond to certain requests if you do not disclose to us certain personal data and do not agree to its processing. 



7. Security 
Lindemans has taken appropriate and reasonable technical and organizational security measures in order to avoid the destruction, loss, forgery, changing of the data, prohibited access and incorrect communication to third parties as well as any other unauthorized processing of the personal data collected. You will, however, understand that we cannot guarantee that a data leak is altogether out of the question, despite the fact that we are doing our best to avoid this. 


8. Other websites – pixels
Lindemans warns you that the Website contains pixels from Facebook, Pinterest, Google, YouTube and Instagram, as well as may contain links, hyperlinks or references to other websites that are not controlled or managed by Lindemans and to which this Policy does not apply. These other social networks and websites have their own privacy and cookie policies, which we advise you to read carefully if you click through to them. Lindemans is not responsible for the processing of your personal data by these third parties and therefore cannot be held responsible under any circumstances. Please bear in mind that these third parties’ privacy and cookie policies may also change regularly. 


9. Minimum age
During every visit to the Website, Lindemans asks to confirm that the visitor reached the minimum age for alcohol consumption. We will never knowingly deal with, nor collect or process data from, minors under the legal drinking age. If, despite this, Lindemans has stored or used this information unwittingly and in good faith, we will remove it as soon as possible after we have been informed.
